Welcome to Apex Surveying & Mapping. These Terms of Service ("Terms") govern your use of our website and professional land surveying services throughout the State of Florida. By requesting a quote, engaging our services, or using our website, you agree to be bound by these Terms.
Please read these Terms carefully before engaging our services. If you do not agree to these Terms, please do not use our services.
1. Description of Services
Apex Surveying & Mapping provides professional land surveying services throughout all 67 Florida counties, including but not limited to:
- Boundary surveys and property line determinations
- ALTA/NSPS Land Title Surveys
- Elevation Certificates for flood insurance
- Topographic surveys for site planning
- Construction staking and layout
- As-built surveys
- Drone mapping and aerial surveying
- 3D laser scanning
- Subdivision platting
- Right-of-way surveys
All surveying services are performed by or under the direct supervision of a Florida-licensed Professional Surveyor and Mapper (PSM) in accordance with Florida Statutes Chapter 472 and the rules of the Florida Board of Professional Surveyors and Mappers.
2. Quotes and Pricing
2.1 Quote Validity
Quotes provided by Apex Surveying & Mapping are valid for 30 days from the date of issuance unless otherwise specified. Quotes are based on information provided by the client and may be subject to adjustment if site conditions or project scope differ from initial descriptions.
2.2 Price Adjustments
Additional charges may apply for:
- Difficult terrain or access restrictions
- Excessive vegetation requiring clearing
- Additional research for complex title histories
- Rush or expedited service requests
- Additional field trips required due to site conditions
- Changes to project scope after work begins
We will notify you of any price adjustments before proceeding with additional work.
2.3 Payment Terms
Payment is due upon completion of services unless other arrangements are made in writing. We accept cash, check, and major credit cards. For larger projects, a deposit of up to 50% may be required before work begins.
3. Client Responsibilities
To ensure accurate and timely completion of your survey, you agree to:
- Provide accurate property information including legal description, deed, and title documents
- Ensure legal access to the property for our survey crew
- Mark or describe any known property corners, monuments, or reference points
- Notify us of any disputes, encroachments, or potential issues with adjacent properties
- Ensure the property is accessible (gates unlocked, dogs secured, etc.)
- Respond promptly to requests for additional information or clarification
- Notify neighbors of survey activity if required by local custom or HOA rules
4. Survey Standards and Accuracy
All surveys are performed in accordance with:
- Florida Statutes Chapter 472 (Professional Surveyors and Mappers)
- Florida Administrative Code Chapter 5J-17 (Standards of Practice)
- ALTA/NSPS 2021 Minimum Standard Detail Requirements (for title surveys)
- FEMA guidelines (for elevation certificates)
- Applicable local county requirements
Survey accuracy meets or exceeds the minimum standards required by Florida law and professional practice. Specific accuracy requirements vary by survey type and intended use.
5. Survey Deliverables
5.1 Survey Documents
Upon completion, you will receive:
- Certified survey plat or map signed and sealed by a Florida PSM
- Legal description (if requested)
- Digital copies in PDF format
- CAD files (available upon request for additional fee)
5.2 Ownership and Use
Survey documents are prepared for the exclusive use of the named client. The original field notes and work files remain the property of Apex Surveying & Mapping. Survey documents may not be altered, modified, or used for purposes other than those for which they were prepared without written authorization.
5.3 Certification
Surveys are certified only to the parties named on the survey document. Additional certifications (e.g., to lenders, title companies, or subsequent purchasers) may be available for an additional fee.
6. Limitations of Liability
6.1 Professional Services
Our liability for professional services is limited to re-performance of the survey or refund of fees paid, at our sole discretion. We maintain professional liability (Errors & Omissions) insurance and general liability insurance for your protection.
6.2 Reliance on Information
Our surveys are based on:
- Information provided by the client
- Public records and recorded documents
- Field observations and measurements
- Available reference monuments and markers
We are not responsible for inaccuracies in source documents, hidden conditions, or information not disclosed by the client.
6.3 Consequential Damages
In no event shall Apex Surveying & Mapping be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services.
7. Dispute Resolution
7.1 Survey Concerns
If you have concerns about your survey results, please contact us promptly. We will review the work and, if warranted, perform additional field work or corrections at no additional charge.
7.2 Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Florida.
7.3 Mediation
Before initiating legal action, both parties agree to attempt resolution through mediation by a mutually agreed mediator.
8. Cancellation and Refunds
You may cancel your survey order at any time. Refunds are provided as follows:
- Before work begins: Full refund of any deposit paid
- After research begins: Deposit less research fees incurred
- After field work begins: No refund (client responsible for work completed)
We reserve the right to cancel a project and refund fees if site conditions make the survey impractical or unsafe.
9. Scheduling and Timeline
Project timelines are estimates based on current workload and typical conditions. Actual completion time may vary due to:
- Weather conditions affecting field work
- County record retrieval delays
- Complex title or boundary issues requiring additional research
- Client response time for required information
- Site access restrictions
We will communicate any significant delays promptly and provide updated timelines.
10. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Apex Surveying & Mapping and is protected by copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.
11. Website Use
By using our website, you agree to:
- Use the website only for lawful purposes
- Provide accurate information when submitting forms
- Not attempt to interfere with the website's operation
- Not use automated systems to access the website
12. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
